The primary purposes of a jurisdiction disposition hearing are twofold. First, the court must determine whether the allegations and the petition are true. Second, if the court decides some or all of the allegations are true, the disposition case plan will be determined. If the court determines that the petition is not true, then the court must dismiss the petition or return your child to your care. If the court decides some or all of the allegations in the petition are true, then the court will order a disposition case plan and determine what you must accomplish before you regain custody of your child. The disposition case plan will include components such as what services you must comply with, what the visitation will be, and where your child will be placed. If you do not agree with DCFS recommendation at the jurisdiction disposition hearing, you are entitled to request a contested hearing. At the contested hearing, you will be able to present your own evidence and witnesses to help the court decide whether the petition is true and what the case plan should be.
