Many people wonder: does a passenger have a claim in a car accident? The law in Texas is pretty clear: anybody who's been injured in a car accident has a claim against anybody who's responsible for that accident. So how does this apply to passengers? Well, in a typical car accident, the passengers have a claim against everybody who's responsible for that accident. That could be their own driver, it could be the other driver, or it could be both drivers. Now, in a single vehicle accident, the same is true: the passengers have a claim against the driver. This is true even if the passengers are related to the driver, married to the driver, or listed on the insurance policy. One thing to remember is that sometimes a passenger will have their own car insurance. So, if they're injured, sometimes their own car insurance policy will cover those injuries, even though they weren't driving.
