Many people wonder: does a passenger have a claim in a car accident? The law in Texas is pretty clear: anybody who's been injured in a car accident has a claim against anybody who's responsible for that accident. So how does this apply to passengers? Well, in a typical car accident, the passengers have a claim against everybody who's responsible for that accident. That could be their own driver, it could be the other driver, or it could be both drivers. Now, in a single vehicle accident, the same is true: the passengers have a claim against the driver.
