In today's episode, we're going to talk about how to start a business in the US if you're not a citizen or resident. There are a lot of special considerations and issues that arise in such situations. It's important to note that being able to form a business in the US is not the same as being able to work or earn an income in the US. While there is no requirement to be a US citizen or have a green card to form a US-based business, it is crucial to have the authorization to work in the US as a non-citizen. This is a separate issue governed by immigration laws, for which you may need to consult an immigration attorney. Forming a business entity in the US can be challenging if you're not a US citizen. One difficulty is obtaining authorization to work, which has specific requirements regarding ownership interest and company structure. These requirements are dictated by visa rules and immigration laws. US citizens enjoy more flexibility in creating and structuring companies. Another challenge is applying for an EIN or tax ID number without a social security number. This can make the process more complex for non-US citizens. On the IRS form SS-4, which is used to obtain a tax ID number, there is a field for the social security number of the responsible party. Non-US residents can indicate their foreign residency and lack of a social security number, and the IRS will usually accept it. However, it depends on the person reviewing your application.
