Now, the Idaho probate law offers different probate procedures for different circumstances. Many probate procedures can be done quickly and fairly inexpensively. For example, there's a simple affidavit procedure to claim property which is in the possession of someone else but belongs to a deceased person. If a surviving spouse is the only heir, then you may be able to use a summary procedure for settling the estate. Sometimes, all that's required is to get a personal representative or an executor appointed for the estate, and this can often be done with an informal procedure, usually within just a week or two. Other times, especially if there's a dispute among heirs, a more formal trial procedure may be required. Each procedure has its own requirements, so it's important to evaluate the circumstances to decide which procedure works best.
