Now, there are two ways that people apply, through a merger with an American citizen. One is if the alien, the future spouse, is already in the United States. The other is if the spouse is outside of the United States when they apply. If the spouse is in the United States and entered legally, we do what's called adjustment of status. The process is relatively quick, taking about six months. During that time, the new immigrant will receive a work permit, a Social Security card, and a driver's license – everything they need to live in the United States. At the end of the six months, there is an interview conducted by immigration officials. The purpose of the interview is to ensure that the applicant has never committed a crime, defrauded the American government, been deported, or has any serious diseases like AIDS. Furthermore, they also want to confirm that the marriage is genuine and not just a convenience marriage, as that would be illegal. If such a fraudulent marriage is discovered, it can have severe consequences for the immigrant, as it will result in a permanent mark on their record that will prevent them from obtaining a green card. Unfortunately, there is no way to avoid this consequence once it has occurred. Upon approval of the marriage and adjustment of status, the person will receive their green card.
